1. About These Terms

These Terms of Service ("Terms") govern your access to and use of evtenders.com ("the Service"), operated by EVT Data Ltd, a company registered in England and Wales (company number 17255478) whose registered office is at 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, trading as EVTenders ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Service Description

evtenders.com provides EV charging tender tracking and procurement intelligence services. We aggregate, classify, and present publicly available tender notices related to electric vehicle charging infrastructure across the United Kingdom. Our services include:

• Searchable database of EV charging tenders from UK public procurement portals
• Tender monitoring and email alerts
• Market analysis and procurement intelligence reports
• Organisation and regional procurement profiles

3. Account Registration

Certain features of the Service require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe are being used in violation of these Terms.

4. Subscriptions and Payment

Access to premium features requires a paid subscription. Subscription terms are as follows:

• Subscription fees are charged in advance on a monthly or annual basis
• All payments are processed securely via Stripe
• Prices are stated in GBP. We are not currently registered for VAT, so no VAT is added to our prices; this may change if our VAT registration status changes.
• You may cancel your subscription at any time; access continues until the end of the current billing period
• We reserve the right to change subscription pricing with 30 days' notice

The Service is provided for business customers. As a business-to-business service, statutory consumer cancellation ("cooling-off") rights under the Consumer Contracts Regulations 2013 do not apply.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or use automated means to access the Service without our written consent
• Attempt to gain unauthorised access to the Service or its related systems
• Reproduce, redistribute, or resell data obtained from the Service without authorisation
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service to transmit harmful code, spam, or malicious content

6. Intellectual Property

The Service, including its design, features, original content, and compilation of data, is owned by EVT Data Ltd and is protected by United Kingdom and international intellectual property laws. The underlying public procurement data is sourced from UK government portals and is subject to the Open Government Licence.

You may not copy, modify, distribute, or create derivative works from our proprietary content, analysis, or platform without our express written permission.

7. Data Accuracy and Disclaimer

While we take reasonable steps to ensure the accuracy and completeness of tender information presented on the Service, we do not guarantee that all information is accurate, complete, or current. Tender data is sourced from third-party public procurement portals and may contain errors or omissions.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, EVT Data Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us.

Provisions that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, and limitations of liability.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
